המאמר דן בשאלה הנוגעת לעקרונות היסוד של החוק הפלילי במקרא: האם מדובר במושכלות ראשונים שעליהם מבוססים חוקי המקרא או שמא עקרונות מעין אלה הם ביטוי מאוחר המסכם נוהג משפטי קדום? המאמר בוחן שאלה זו תוך השואה למקורות מסופוטמים שקדמו בכאלף שנה לקובצי החוק שבמקרא. (מתוך המאמר)
