Abstract
בעקבות פסיקת גלאדו (Gladue) והשלכותיה בקנדה על יחס עונשי מיוחד לקבוצה אתנית. המאמר עוסק בשאלה האם ראוי להתחשב במוצא האתני וברקע התרבותי המיוחד של עבריינים כבסיס להקלות בהליך הפלילי ואף להקמת בתי משפט מיוחדים עבורם, על רקע הכרה בכך שהמדינה גרמה עוול במהלך ההיסטוריה לבני אותו מיעוט. המחבר בוחן כיצד הדין הפלילי הקנדי מתייחס לבני המיעוט האבוריג'יני.
