Abstract

Although commonly used in the context of regulating artificial intelligence, the term algorithmic transparency is opaque. This paper explores the complexity of defining and implementing algorithmic transparency, tracing its roots in administrative law and its application in private and commercial contexts. The paper identifies the challenges of achieving transparency due to AI systems' inherent 'black-box' nature and proposes a novel, three-stage framework to ensure meaningful transparency. By focusing on the purpose, statistical robustness, and proper implementation of AI systems, this framework aims to balance the need for transparency with the practical limitations of current AI technology. This approach seeks to maintain accountability, trust, and protection of human rights while allowing for technological innovation and practical application.
