Abstract
By introducing a proper penalization on an approximate form of the continuity equation, the use of Lagrange multipliers, is avoided without introducing any ill-conditioning in the linear (or non-linear) systems to be solved. This construction is given for several 2D elements. Using the most accurate of these elements, an example is given of a time dependent viscous incompressible flow.
