Abstract
"5 The communicative account, the analysis further proposes, should serve as an organizing principle in determining the thresholds, the scope and the contours of copyright protection. [...]the notions of speech (the author's autonomy as a speaking being), equality (the author as an ''author among authors") and dialogue, should replace the concepts of value, efficiency and balance that prevail the utilitarian account.6 This core insight unfolds throughout the book, accompanied by a close reading of several foundational common-law copyright cases, which are explored through the communicative lens. [...]perhaps the best way to describe What's Wrong With Copying? is by using the book's own terms.
