Abstract

The term “unlawful” or “unprivileged” combatant does not appear in international conventions on the law of war. It does not denote a recognized status of persons involved in war or armed conflict. Nevertheless, the term is widely used to describe persons who lack combatant status under international law but take an active part in hostilities in an international armed conflict.
